NFL taking hits for brain injuries - sued for wrongful death

While Alaskans may or may not hunker down for Super Bowl weekend with our food, drinks, and party guests to watch the commercials and see some big hits, some fans will be mourning the spectacle instead. With more and more former players suffering from chronic traumatic encephalopathy (CTE) and taking their lives as a result, many families and former players will be suffering through the finale of this NFL season.

Junior Seau was one such player who suffered from CTE and committed suicide. His action was one that shocked the nation and the football world as he was a fun-loving and charismatic player and veteran of 20 years in the league. His family is now suing the NFL for wrongful death as well as fraud and negligence.

A wrongful death claim can involve many types of fatal accidents, ranging from auto accidents to the rare case of a helicopter crash or death from CTE. A wrongful death claim exists when a person perishes due to the legal fault of another. Persons and companies may be found legally at fault should they have acted either intentionally or negligently (failing to act as a reasonably prudent person would have acted).

The family is claiming that the NFL has for years been concealing the actual facts behind the continual head trauma that players experience within the game of football. The family alleges that this deception has lead to the risk of neurological injury for all who play the game and lead directly to the CTE that Junior Seau experienced which resulted in his death. The family wants to send a message to the NFL that the risks that they are taking with players and their families' lives are unacceptable and need to be quickly and adequately addressed.
