Wrongful death lawsuit could follow fatal accident

When an Alaska family loses a loved one due to the negligent actions of another, the family has the right to seek legal recourse in the matter. Many families choose to pursue a wrongful death lawsuit after the death of a loved one for a variety of reasons. Some are hoping to recover financial losses, such as medical costs, loss of property and the loss of that family member's income. Others are simply looking for justice in the matter and a public recognition of the events that led to the loss of life.

An example may lie in the recent death of a 66-year-old man who was struck and killed while riding a scooter. The man was travelling in the outbound lane of the Glenn Highway near the Joint Base Elmendorf-Richardson when the collision took place. Police report that a red SUV was moving in the same lane and same direction of travel when the two vehicles collided.

The incident is still under investigation, and the Anchorage Police Department has issued a statement to say that the cause of the accident has not yet been determined. The driver of the SUV stopped at the site and remained on the scene until emergency responders arrived. Since that time, the driver has cooperated with the investigation, and no charges have been filed in the matter.

All Alaska drivers have responsibilities toward those with whom they share the road. This includes the duty to continually scan the road for the presence of other vehicles, whether those are cars, trucks or smaller vehicles like motorcycles and scooters. Failure to remain aware of other vehicles is a serious matter and can lead to fatalities as the one mentioned here. Should the investigation reveal that the driver of the SUV was at fault in the crash, criminal charges could be filed. A wrongful death suit is also a possibility should the family decide to pursue that option.
