Wrongful death claim outside Alaska captures nation's attention

Media reports have grabbed public attention regarding a recent legal claim filed by parents on behalf of their deceased daughter. The 1-year-old girl died in a tragedy that led to the prosecution of the child's nanny. The parents have filed a wrongful death claim against the nanny in a state outside Alaska, stating that they want to prevent the woman from profiting from their child's death.

The couple suffered the untimely death of their daughter in 2013. She apparently died from severe brain swelling and bleeding. Murder charges against the baby's Irish nanny were later dropped when a medical examiner changed the cause of death from homicide to undetermined.

Because the medical examiner listed prior medical conditions as a possible significant factor in the toddler's death, the murder charges against the nanny were dropped. However, the child's parents have filed a civil lawsuit because they feel the nanny was responsible for the child's death, and they fear the nanny will attempt to profit from their daughter's death through book and movie deals. They said they feel compelled to protect their daughter's memory by making it legally impossible for the nanny to do this.

A wrongful death claim may be filed in Alaska or other states when an immediate family member believes that a loved one's death has been caused by the negligent or wrongful actions of another person.
