Damages that may be awarded in wrongful death claims

There may no more devastating event than the unexpected loss of a loved one. Friends and family members can be shocked, overwhelmed by grief and struggling to make any sense of the situation. While there is certainly no way to replace that person or undo the loss, there are things you can do to take control of the situation and try to find some closure.

Filing a wrongful death claim is one option if recklessness or negligence of someone else led to your loved one's death. It is a means of acknowledging your loss, the pain that your loved one experienced and the bad behaviors that caused the loss through various types of damages.

Pecuniary damages

Pecuniary damages include those that can be easily calculated and added up. For instance, you might be awarded damages to cover medical bills, loss of wages, loss of future income and funeral expenses.

Noneconomic damages

These damages can be much more complicated to calculate because they are based on the intangible impact of loss. As noted in Alaska state laws, noneconomic losses can include pain, suffering, disfigurement, loss of consortium, inconvenience, anguish and fear that your loved one may have experienced.

Punitive damages

These damages are not available in every case. In fact, they are reserved only for cases where the defendant’s action or inaction was particularly malicious or reckless, as they are damages that are intended specifically to punish the negligent or reckless party

We understand that no amount of money awarded in a court case will truly compensate you for the death of a loved one, and in fact, money may be the last thing on your mind. However, by filing a legal claim, you can hold the appropriate parties accountable for the loss and recover financial damages that can make it just a little easier to cope with the impact of your loss.
